PULSE is built from publicly available market data, exchange-reported prices, government statistics and selected commercial benchmark references. Proprietary index construction, weighting methodology and forward forecasts are developed exclusively by Comutiq analysts.

"Comutiq" means Comutiq Ltd., registered in England and Wales (company number 12009998), registered office: 18 Northgate, Sleaford, NG34 7BJ, United Kingdom.
"PULSE" means the market intelligence report and associated data services offered at thepulsedata.com, produced by Comutiq.
"Report" means any monthly PULSE publication, data extract, index table, briefing note, chart, commentary or forecast delivered as part of a subscription.
"Subscriber" means any individual, company or organisation that places a subscription order with Comutiq.
"Subscription" means the paid access to PULSE Reports for a defined period under a plan selected at the time of order.
"Indicative Data" means any data, index value, forecast, estimate or commentary contained in a Report that is produced for informational purposes and does not constitute advice of any kind.
"Confidential Information" means all Report content, index methodologies, weightings, proprietary models and non-public data provided to the Subscriber.
2.1 All subscriptions are concluded by email order. The Subscriber submits a request via the form on thepulsedata.com; Comutiq then issues a proforma invoice by email. A binding subscription agreement is formed only upon Comutiq's written confirmation of the order and receipt of cleared payment.
2.2 Subscriptions are for single named-entity use. A subscription covers delivery to one named contact within the Subscriber's organisation, unless a multi-seat licence has been agreed in writing. Organisations requiring broader distribution — including PULSE Enterprise (custom index, white-label) and Tier 1/OEM group licences — should contact Comutiq to discuss a tailored commercial addendum or NDA, which may be required prior to delivery of bespoke deliverables.
2.3 Comutiq reserves the right to decline any order at its sole discretion, including where a potential conflict of interest or competitive use is identified.
2.4 Subscription plans, pricing and deliverables may be modified by Comutiq with 30 days' written notice to existing Subscribers. If a Subscriber objects to a material change, they may cancel under clause 4 without penalty for the unexpired portion of the current period.
2.5 B2B Supply Only. For the avoidance of doubt, PULSE is supplied to business customers only. By placing an order, the Subscriber confirms it is acting for business, trade or professional purposes and not as a consumer. Consumer protection legislation that applies exclusively to consumers does not apply to PULSE subscriptions.
3.1 All prices are stated in Euros and exclude VAT unless otherwise stated. VAT is applied in accordance with applicable law based on the Subscriber's billing country and status. EU companies providing a valid VAT number may be eligible for VAT reverse charge under applicable EU regulations.
3.2 All subscriptions are invoiced in advance on an annual basis. Payment is due within 14 days of the invoice date, by bank transfer or card via the secure link on the invoice.
3.3 Subscriptions are activated only after Comutiq has received cleared funds. Report delivery begins on the next scheduled distribution date following activation.
3.4 Late payments may incur statutory interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998. Comutiq reserves the right to suspend delivery of Reports and provision of briefing calls where payment is overdue by more than 30 days.
3.5 All invoices and payment communications will be sent to the email address provided at the time of order. It is the Subscriber's responsibility to ensure this address remains valid.
4.1 Subscriptions renew automatically on an annual basis unless cancelled in writing to info@comutiq.com at least 30 days before the renewal date.
4.2 Cancellations take effect at the end of the current subscription period. No refunds are issued for unused portions of a paid subscription period, except where Comutiq has materially failed to deliver the subscribed service.
4.3 Where Comutiq modifies a subscription plan materially under clause 2.4 and the Subscriber exercises their right to cancel, a pro-rata refund for the unexpired period will be issued within 30 days.
4.4 Comutiq may terminate a subscription immediately upon written notice if the Subscriber: (a) breaches any provision of these Terms; (b) uses Reports in a manner that competes with or substitutes for PULSE commercially; or (c) fails to pay an invoice within 60 days of its due date. No refund is due upon termination for breach.
5.1 PULSE Reports contain market data, cost indices, economic analysis, geopolitical commentary and forward-looking estimates compiled by Comutiq from publicly available, licensed and proprietary sources. All such content constitutes Indicative Data and is provided for informational and research purposes only.
5.2 PULSE Reports do not constitute and must not be construed as: financial advice, investment advice, trading recommendations, legal advice, tax advice, commercial advice, or any other form of regulated professional advice.
5.3 Comutiq is not authorised or regulated by the Financial Conduct Authority (FCA) or any other financial regulatory authority. PULSE is a data intelligence and market research product, not a financial service.
5.4 Subscribers must not rely solely on PULSE Reports when making investment, procurement, trading, financing or strategic business decisions. Independent verification and professional advice should be sought for all material decisions.
5.5 All index values, forecasts and price estimates are produced in good faith based on the information available at the time of publication and reflect Comutiq's analytical judgement. They are not guarantees of future performance, price movements or market conditions.
5.6 Historical data in Reports may be revised in subsequent editions when source corrections, methodological improvements or data restating occurs. Comutiq will note material revisions but is not obliged to notify Subscribers individually. Material changes to index methodology, component weightings or base-period reference dates will be flagged prominently within the relevant Report edition and documented in the methodology appendix, to support Subscribers' cost-modelling and audit requirements.
6.1 All content in PULSE Reports — including but not limited to index methodologies, cost models, data compilations, analysis, charts, tables, commentary and forecasts — is the exclusive intellectual property of Comutiq Ltd. and is protected by copyright and database rights under UK and international law.
6.2 A subscription grants the Subscriber a personal, non-exclusive, non-transferable, non-sublicensable licence to access and use PULSE Reports solely for their own internal business purposes during the subscription period.
6.3 The Subscriber may not, without prior written consent from Comutiq: (a) reproduce, copy, republish, upload, post or transmit Reports in whole or in part; (b) resell, redistribute or share Reports with third parties, clients, affiliates or subsidiaries; (c) incorporate Report content into products or services offered to third parties; (d) use Report content for commercial data resale or aggregation; (e) remove or obscure any proprietary notices or attributions; (f) use Report content — in whole or in part — to train, fine-tune, or otherwise develop any artificial intelligence, machine learning or large language model system, whether commercial or internal. Derived data outputs generated by such systems using PULSE Report content are also covered by this prohibition unless separately authorised in writing by Comutiq.
6.4 Brief quotation of PULSE data within internal presentations, board packs and similar internal materials is permitted provided it is clearly attributed as: "Source: PULSE by Comutiq — thepulsedata.com" and does not represent a substantial portion of any Report. Use of Report content in materials distributed externally to clients or third parties requires Comutiq's prior written consent.
6.5 White-label licensing, multi-seat distribution licences and resale rights are available under a separate written commercial agreement with Comutiq.
6.6 Export Controls and Sanctions. The Subscriber represents and warrants that: (a) it is not a Sanctioned Person (as defined by applicable UK, EU, US or UN sanctions regimes, including the UK Sanctions List, OFSI guidance, EU sanctions regimes, UN sanctions regimes and OFAC sanctions programmes); (b) it will not use, share or re-export Reports in breach of any applicable export control laws or economic sanctions; and (c) where the Subscriber operates in or with counterparties in regulated jurisdictions — including in relation to battery critical minerals, dual-use technologies, or automotive supply chains subject to trade controls — it is solely responsible for ensuring its own compliance. Comutiq reserves the right to suspend or terminate subscriptions immediately if it has reasonable grounds to believe a Subscriber is in breach of this clause.
7.1 Reports are delivered to the Subscriber in confidence. The Subscriber agrees to treat all Report content as Confidential Information and to implement reasonable measures to prevent unauthorised access, copying or disclosure.
7.2 The Subscriber must not share login credentials, Report files or data extracts with persons outside their organisation. Where the Subscriber suspects a breach of confidentiality, they must notify Comutiq promptly at info@comutiq.com.
7.3 Confidentiality obligations survive termination of the subscription for a period of three (3) years.
8.1 Comutiq uses reasonable care and professional judgement in compiling PULSE Reports. However, Comutiq makes no representation or warranty, express or implied, as to the accuracy, completeness, timeliness or fitness for a particular purpose of any data, index value or commentary contained in a Report.
8.2 Data sourced from third-party providers is used in good faith. Comutiq is not responsible for errors, omissions or delays originating from third-party data sources.
8.3 To the extent permitted by applicable law, all warranties, conditions and representations not expressly stated in these Terms are excluded, including any implied warranty of merchantability or fitness for purpose.
9.1 Comutiq's total aggregate liability to the Subscriber under or in connection with any subscription — whether in contract, tort (including negligence), breach of statutory duty or otherwise — shall not exceed the total fees paid by the Subscriber in the 12 calendar months immediately preceding the event giving rise to the claim.
9.2 Comutiq shall not be liable, under any circumstances, for any: (a) loss of profit or revenue; (b) loss of business, contracts or goodwill; (c) financial loss arising from trading or investment decisions made on the basis of Report content; (d) loss of data; (e) indirect, consequential, special or punitive loss or damage — even if Comutiq has been advised of the possibility of such loss.
9.3 The Subscriber expressly acknowledges that PULSE Report content is Indicative Data (clause 5) and that no liability attaches to Comutiq for any commercial outcome resulting from reliance upon it.
9.4 Nothing in these Terms limits Comutiq's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded or limited by applicable law.
10.1 Comutiq processes personal data in accordance with its Privacy Policy, available at thepulsedata.com or such other URL as Comutiq may notify from time to time. Personal data is used for subscription administration, billing, service delivery, renewal communication and related business purposes.
10.2 Subscribers have rights regarding their personal data, including access, rectification, erasure and the right to object. Full details of how personal data is collected, used, stored and transferred, and how to exercise data subject rights, are set out in the Privacy Policy. Requests may also be sent directly to info@comutiq.com.
11.1 Comutiq shall not be liable for any failure or delay in delivering Reports arising from circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, war, civil unrest, failures of third-party data providers, telecommunications outages or government action. In such circumstances, Comutiq will notify Subscribers promptly and make reasonable efforts to resume delivery.
11.2 Without limiting the generality of clause 11.1, Comutiq is not responsible for errors, delays, suspensions or inaccuracies originating from upstream third-party data sources upon which PULSE Reports rely. Where material upstream data errors are identified, Comutiq will use reasonable endeavours to issue corrections in the following Report edition.
12.1 Comutiq may update these Terms and Conditions at any time. Subscribers will be notified of material changes by email at least 14 days before they take effect. The current version is always published at thepulsedata.com. Continued use of a subscription after the effective date of any change constitutes acceptance of the revised Terms.
13.1 These Terms and Conditions and any dispute or claim arising from or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.
13.2 Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13.3 Before initiating formal proceedings, the parties agree to attempt to resolve any dispute by good faith negotiation. Subscribers should contact info@comutiq.com in the first instance. If the dispute is not resolved within 30 days, either party may pursue formal legal remedies.
14.1 These Terms constitute the entire agreement between Comutiq and the Subscriber in respect of PULSE subscriptions and supersede all prior representations, discussions and agreements.
14.2 If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed and the remaining provisions shall continue in full force.
14.3 No failure or delay by Comutiq in exercising any right under these Terms shall constitute a waiver of that right.
14.4 The Subscriber may not assign or transfer any right or obligation under these Terms without Comutiq's prior written consent. Comutiq may assign its rights and obligations to any successor entity without restriction.
